LETTER TO THE DIRECTOR OF STATE LANDS REGARDING THE PUBLIC AUCTIONING OF STATE LANDS.
By instruction N°000004/Y.2.5/MINDAF/D 220 of 29 December 2005, I prescribed that the sale of state lands should henceforth be by public auction in accordance with the law; whereas sales by private treaty would remain the exception subject to the Minister’s authorization.
Thus, the public sales auction procedure shall be conducted directly by the DO supported by the divisional board in accordance with Art 6 of decree 76/167 of 25 April 1976 to establish the terms and conditions of the management of the private property of state. Only the report of the public sales auction shall be forwarded for the approval of the Minister.
The study of the files for the approval of the report of auction sales forwarded for the approval of the Minister shall high the price of lands sold in comparison with the price of the free market in that locality.
The files for sales by private treaty of state lands shall be submitted for the Minister’s approval following the recommendation of the committee for state land revenue collection set up by Decision N°000455 of 17 February 2006.
