Instruction N°0000001/Y.7/MINDAF/D100 of 25 June 2007 to recall provisions governing the management of 2nd category national lands

My attention has been drawn to misdemeanors plaguing the management of second category national lands.

In effect, many development projects on such lands often earmark large parcels having nothing to do with their real importance, and grant little security in terms of their sustainability and socio-economic development impact on the locality where they are planted.

The proliferation of such malpractices, especially in boarder zones and/or in areas witnessing heavy demographic pressures, is likely to hamper the rational and pacific management of such lands, due to social disorders and conflicts stemming there from.

Besides, application files for second category national lands allocations are not always compiled in respect of the legal and regulatory provisions in force ; this concerns documents to be provided for by applicants, the exceedingly low prices charged for leases on certain lands, and the forwarding conditions to my services of files thereof.

In this regard, it is important to recall that, pending the outcome of the reform underway; the management of 2nd category national lands shall be governed by decree n°76/166 of 27 April 1976 to establish the modalities thereof.

Consequently, the compilation of application files for leasehold or freehold grants on 2nd category national lands shall henceforth be underlined by the pertinent provisions of the said decree, especially articles 4, 5, 6, 7, 8, 9, 10 and 11.

Upon the granting of the Consultative Board’s reasoned recommendation, complete files shall be forwarded to me, for action, together with a draft Articles and conditions whose signature is subjected to the prior signing, by the Minister of state property and land tenure, of an order to grant a leasehold.

I attach much importance to the respect of the provisions contained in this Instruction.
